An ICDR® & ITechLaw Study: Resolving Technology Disputes across All Industry Sectors

International technology disputes have dramatically risen, and are increasingly emerging across all industry sectors, including information technology, intellectual property, life sciences, aerospace, aviation, construction, and energy. Because of this growth, the International Centre for Dispute Resolution® (ICDR) and ITechLaw are collaborating in a global effort to obtain and study the feedback of experienced international practitioners on the use of arbitration and mediation in the resolution of technology disputes of all types.

The results will be documented in a report setting forth practical proposals for what the dispute resolution community, including the ICDR, should do to assist the information technology and other industries in resolving their technology and intellectual property-related disputes. Join us in an interactive discussion highlighting the key issues, topics, concerns, and suggestions related to this international dispute resolution study.

Steven Andersen, International Centre for Dispute Resolution, United States
Steve Andersen, VP, ICDR Steve has over 20 years’ experience as an international dispute resolution professional. He is the point person to interface and collaborate with legal professionals, industry groups, advisory committees in the technology, energy, finance, aerospace, aviation, and construction industries in locations around the world. Steve dedicates a substantial amount of time organizing and facilitating international dispute resolution education including multiple events in the North America, Europe, Asia, and South America. Inaugural winner of the Outstanding Contribution to Technology Dispute Resolution Award by Silicon Valley Arbitration & Mediation Center. Steve oversaw and managed the 2021 ICDR Rule Amendments.

Ethan Berghoff, Baxter International, United States
Ethan A. Berghoff is an associate general counsel with Baxter International where he currently serves as the legal lead for Baxter’s Front Line Care business.  Prior to joining Baxter, Mr. Berghoff was a partner in Baker & McKenzie LLP’s Chicago office, specializing in international arbitration and international litigation. Mr. Berghoff has represented U.S. and non–U.S. entities in a wide variety of disputes in litigation before the U.S. state and federal courts and in international arbitration before various arbitral authorities around the world.

Maria Chedid, Arnold & Porter, United States
Maria Chedid is global co-chair of the International Arbitration group at Arnold & Porter. She regularly serves as lead counsel in commercial and investment arbitrations, and frequently is called upon to serve as an arbitrator. Over the last three decades, she has handled arbitrations administered by all major arbitral institutions including the ICC, ICDR, SIAC, LCIA, ICSID, DIAC, CPR, JAMS, PCA, and the AAA, as well as arbitrations conducted under the UNCITRAL Rules, by the Iran-United States Claims Tribunal, and by the United Nations Compensation Commission. Maria brings a wealth of arbitration experience involving diverse subject matter and expansive geographic reach and is particularly known for her expertise in technology, IP, and life sciences disputes. She co-chairs the ICDR Global Working Group on the Resolution of Technology and Life Sciences Disputes and is currently serving her second term as one of two members representing the United States on the ICC Court of Arbitration. Maria has presented on international dispute resolution and advocacy at conferences worldwide and at numerous law schools, including UC Berkeley, Harvard, Stanford, Columbia, USC, and at the Straus Institute for Dispute Resolution at Pepperdine Law School, where she has taught as an adjunct professor. Maria is admitted to practice in both New York and California, is multi¬lingual, and is a dual citizen of the U.S. and Lebanon.

Bryan Sinclair, Cisco, United States
Bryan Sinclair is the Sr. Director of IP Litigation at Cisco where he oversees an incredibly talented team and the management of all of Cisco’s intellectual property litigation in U.S. District Courts, the ITC, PTAB, Federal Circuit, and U.S. Supreme Court as well as foreign jurisdictions. Prior to joining Cisco in 2017, Bryan was an IP litigation partner in K&L Gates Palo Alto office for over seven years and practiced in several international law firms over the course of the last 25 years. Bryan started his legal career as a judicial clerk for the Honorable Peter T. Fay of the U.S. Court of Appeals for the 11th Circuit. Over the course of his career, Bryan has served as lead counsel in numerous arbitrations involving intellectual property disputes regarding IP ownership, the scope of patent license rights, and served as an expert witness in a SIAC arbitration proceeding in London. While leading the IP Litigation team at Cisco, he regularly participates in mediations involving intellectual property and has participated in the negotiation of many settlement agreements containing dispute resolution provisions for IP disputes.

Claudia Götz Staehelin, Kellerhals Carrard, Switzerland
Dr Claudia Götz Staehelin is a Partner at Kellerhals Carrard and represents her clients before courts and arbitration tribunals in all areas of commercial law and, as Head of Investigations at Kellerhals Carrard, leads internal and regulatory investigations. She advises clients on pharmaceutical law, healthcare compliance, white collar criminal law, international legal assistance, and data protection. Based on her experience as former Head of Litigation at Novartis, she regularly assists companies with multi-jurisdictional projects at the intersection of dispute resolution, compliance, digital, data and information governance. She has extensive international experience in litigation and investigation risk assessment, in crisis management and in assisting companies in strategic decision-making. Claudia Götz Staehelin is listed by the most important international legal directories as one of Switzerland's leading business lawyers in the areas of Life Sciences and White-Collar Crime/Investigation (Chambers Europe 2022, Legal 500 2022, “Next Generation Partner” for Health Care and Life Sciences, “Leading Individual” for Regulatory, Compliance and Investigations). Claudia is a Swiss qualified lawyer, was admitted to the bar in 2001 and received her Doctor of Law from the University of Basel.
