This month’s 15-minute discussion topic comes from Kelley Loo and Dora Si of Deacons in Hong Kong.

  • At the first session, Kelley will discuss a recent case in Hong Kong on the right to be forgotten.
  • At the second session, Dora will provide a quick summary on the draft PRC Personal Information Protection Law.

Kelley Loo is qualified as a solicitor in Hong Kong and New Zealand.  She holds a Bachelor of Laws degree from the University of Auckland, New Zealand and has obtained Postgraduate Certificate in Laws from the City University of Hong Kong.  Kelley’s practice covers all aspects of IP work including enforcement of IP rights and IP protection strategy. She has extensive experience advising on contentious and non-contentious IP issues and handles IP litigation matters at the Hong Kong Courts (including applying for or resisting urgent interim injunctions), arbitrations and proceedings at the Hong Kong Trade Marks Registry, and has won a number of cases for her clients.  Kelley also advises on all aspects of commercial IP matters (including franchise agreements and license agreements), data protection matters (including handling data breaches) and national security law as relevant to online platform clients.   Kelley’s clients include those in luxury goods, sports, social media, biotechnology, film distribution, financial and co-working industries. Kelley also acts as an on-site legal advisor at major trade fairs in Hong Kong and regularly conducts presentations on IP rights and enforcement mechanisms to clients.

 

 

 

Dora Si is qualified in Hong Kong and England and Wales. She holds an LLB (Hons) from University of Hong Kong and LLM (Commercial and Corporate Law) from University of London.  Dora’s practice covers all aspects of IP protection and enforcement.  Dora is specialised in trade mark counselling, clearance, filing strategy and trade mark portfolio management for clients in a variety of industries, including food products, public transport, banks, real estate service, construction materials, fashion, cosmetics, sports equipment, hotels, and other consumer products and services.  In particular, Dora advises on brand protection and anti-counterfeiting strategies, domain name disputes, copyright protection, data protection and internet issues in the PRC.  Dora has also handled complex cross-border infringement issues, and managed AIC raid actions and contentious proceedings in various parts of China.  Dora also advises on IP aspects of commercial transactions and has experience in developing effective strategies for IP monetisation and intellectual asset management, conducting IP audits for mergers and acquisitions, as wells as negotiating and drafting licences and other general commercial agreements relating to the use and acquisition of IP rights. Dora also has experience in recording franchise arrangements with MOFCOM and advising on compliance issues related to internet regulation, data privacy and online marketing in China.
